Terms of service
The agreement, in plain English
Effective September 5, 2026. By using TouchPoppy you agree to these terms with PeopleStar Enterprises, Inc. ("we").
Who may use it
Licensed real estate professionals and their teams. Every account is asked to verify a real estate license before the product opens, and a person on our team reviews it. You must be 18 or older.
Your account and your plan
Plans are Agent, Signature and Executive, priced as shown at touchpoppy.com/#pricing and billed by Stripe monthly or annually. Individual plans start with a 14-day free trial; a card is required and you may cancel at any time from Settings or the billing portal. Cancelling stops the next charge; you keep the service until the period you paid for ends. Annual plans are ten times the monthly price. Prices may change with 30 days' notice by email. TouchPoppy is also included in the OfficePoppy™ Suite.
What you are responsible for
- Everything you send. TouchPoppy drafts; you decide. Read every text and email before it goes to a client. You are the sender of record for every message, including reports sent on a schedule you turned on.
- Having the right to store your clients' information and to contact them, and honoring any request from a client to stop.
- The accuracy of your notes and listings. A draft is only as true as what it was written from.
- Keeping your sign-in email secure. Sign-in codes are for you alone.
- Complying with your brokerage's rules, your MLS rules, and the laws where you practice, including the TCPA and CAN-SPAM as they apply to messages you send.
What we are responsible for
Running the service with care, keeping your data private as described in our privacy policy, and telling you promptly if something goes wrong on our side. We aim for the service to be available at all times but do not guarantee it; we do guarantee that your data is yours and that you can export it and leave.
What we do not promise
TouchPoppy is a drafting and reminder tool, not a substitute for your judgment. Drafts can be wrong. Market figures come from third-party data and may lag. We are not liable for a message you sent, a listing that did not sell, or a decision made on the strength of a draft. To the extent the law allows, our total liability to you is the amount you paid us in the twelve months before the claim.
Acceptable use
Do not use TouchPoppy to send unsolicited messages, to harass anyone, to store information you have no right to hold, or to attack the service. We may suspend an account that does.
Ending the agreement
You may delete your account at any time from Settings. We may close an account for a breach of these terms after telling you why. Sections about responsibility and liability survive.
